Mihlali Sitefane specialises in mining, environmental and administrative law.
Her experience includes advising on a wide range of mining transactions, including listings on the AIM London Stock Exchange, contractorship arrangements, joint venture agreements, empowerment transactions, acquisitions and disposals.
Her expertise extends to conducting due diligence investigations, compiling mining title reports, undertaking mining litigation, drafting and lodging mining title applications, appeals, and responses in terms of Mineral and Petroleum Resources Development Act, 2002 (“MPRDA”), as well as registering mining titles at the Mineral and Petroleum Titles Office. Furthermore, she has experience in establishing, registering and amending trusts, including environmental rehabilitation trusts.
Mihlali has also advised clients on empowerment matters relating to the MPRDA, the Mining Charter and the Broad-Based Black Economic Empowerment Act, 2003, as well as on the intersection between the MPRDA and the Labour Relations Act, 1995, specifically in relation to the downscaling of mining operations.
Mihlali’s expertise extends to the all aspects of environmental law including but not limited to the National Management Environmental Act, 1998, National Water Act and the National Environmental Management: Waste Act, 2008.
She has advised on cross-border mining transactions and has conducted extensive research on the mining industry in Zimbabwe, Namibia, Botswana, Uganda and Tanzania
